These Terms & Conditions govern all services provided by Clark's Courier Services Ltd ("we", "us", "our") to any customer ("you", "your"). By booking or using our services, you agree to be bound by these Terms & Conditions.
1. Company Details
Clark's Courier Services Ltd is a registered company in England and Wales (Company No. 16773390). All services are provided subject to these Terms & Conditions unless otherwise agreed in writing.
2. Services
We provide courier, transport, and logistics services including (but not limited to) same- day delivery, next-day delivery, multi-drop deliveries, specialist and time-critical transport.
We reserve the right to refuse the carriage of any item that we deem unsafe, illegal, inadequately packaged, or outside our operational capabilities.
3. Bookings & Instructions
All bookings must include accurate and complete information, including:
- Collection and delivery addresses
- Nature of the goods
- Weight, dimensions, and value
- Any special handling requirements
Failure to provide accurate information may result in delays, additional charges, or refusal of service.
4. Packaging & Customer Responsibilities
You are responsible for ensuring that all goods are:
- Properly packaged for road transport
- Suitable for handling and transit
- Securely packed to prevent damage
We are not liable for damage caused by inadequate packaging or failure to declare fragile or high-value items.
5. Prohibited & Restricted Goods
Unless expressly agreed in writing, we do not carry:
- Illegal or unlawful goods
- Dangerous, explosive, or hazardous materials
- Perishable goods requiring controlled temperatures
- Live animals
Any prohibited goods carried without disclosure are done so entirely at your own risk.
6. Insurance & Coverage
6.1 Insurance Overview
Clark's Courier Services Ltd holds appropriate insurance policies to protect goods while in our care, custody, and control. Insurance cover applies only where goods are accepted for carriage in accordance with these Terms & Conditions.
6.2 Goods in Transit Insurance
All consignments are covered by Goods in Transit (GIT) Insurance from collection until delivery is completed, subject to policy limits and exclusions.
Covered risks may include:
- Accidental damage during loading, transit, or unloading
- Loss or theft of goods while in our care
- Damage resulting from road traffic accidents
- Weather-related damage during transit
Conditions of cover:
- Goods must be adequately packaged
- All items must be accurately declared at booking
- Fragile or high-value items must be declared in advance
- Standard insurance limits apply unless additional cover is agreed in writing
Failure to meet these conditions may invalidate insurance cover.
6.3 Exclusions & Limitations
Unless agreed in writing prior to collection, insurance does not cover:
- Undeclared high-value items
- Fragile goods not declared at booking
- Inadequately packaged items
- Perishable goods spoiled due to delays beyond our control
- Consequential or indirect losses, including loss of profit
Liability is limited to the repair or replacement value of the goods, up to the maximum policy limit.
6.4 Public Liability Insurance
We maintain Public Liability Insurance to cover third-party injury or property damage arising from our operations, including:
- Third-party bodily injury
- Third-party property damage
- Legal costs relating to covered claims
- Accidental damage to customer premises during collection or delivery
6.5 Additional Insurance
Additional insurance can be arranged upon request before collection for consignments that:
- Exceed standard value limits
- Include fragile, antique, or irreplaceable items
- Require specialist handling or temperature control
- Contain regulated materials
Failure to request additional insurance where required may limit or exclude liability.
7. Claims Procedure
Any claim for loss or damage must comply with the following:
- Damage or loss must be reported immediately upon delivery or discovery
- Photographic evidence must be provided
- Notification must be made within 24 hours
- All original packaging must be retained
- Proof of value must be supplied
Failure to follow this procedure may result in the claim being rejected.
8. Delivery Times & Delays
All delivery times are estimates only. We are not liable for delays caused by factors outside our control, including but not limited to traffic conditions, weather, mechanical failure, or acts of third parties.
9. Charges & Payment
All charges are payable in accordance with agreed payment terms. Late payments may result in additional charges or suspension of services.
We reserve the right to withhold delivery of goods pending payment where legally permissible.
10. Liability
Our liability is limited to the extent permitted by law and subject to applicable insurance limits. We shall not be liable for:
- Indirect or consequential losses
- Loss of business, profit, or reputation
- Losses arising from incorrect instructions or declarations
Nothing in these Terms excludes liability for death or personal injury caused by negligence.
11. Force Majeure
We shall not be liable for failure to perform services due to events beyond our reasonable control, including natural disasters, strikes, accidents, or government restrictions.
12. Termination
We reserve the right to refuse or terminate services immediately if these Terms & Conditions are breached or if continuing the service poses a risk.
13. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
